Counter-Notification
If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to our designated copyright agent:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your location and that you will accept service of process from the person who provided notification of infringement or an agent of such person
Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our service and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Processing of Notices
Upon receipt of a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the material that it has been removed or access has been disabled
- Terminate the accounts of repeat infringers in appropriate circumstances
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original claim of infringement. The original complainant will then have ten business days to notify us that they have filed legal action relating to the allegedly infringing material. If we do not receive such notification, we may restore the removed material or cease disabling access to it.
False Claims
Please be aware that under the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from any party that submits a notification or counter-notification in violation of the law.
Educational Use and Fair Use
Before submitting a DMCA notice, please consider whether the use of copyrighted material at issue falls under fair use. Fair use is a legal doctrine that permits limited use of copyrighted material without acquiring permission from the rights holders. User-Generated Content
